MAHARA SHALA /
LAURA HUMPHREYS PARTICIPATION AGREEMENT
Warning: This is an important document which affects your legal rights and obligations. Please read it carefully and do not agree to it unless you are satisfied you understand it.
For and in consideration of MAHARA SHALA / LAURA HUMPHREYS (collectively “Mahara Shala/Laura Humphreys”) granting me permission to attend and participate in a Mahara Shala/Laura Humphreys class, course, or workshop whether online or at a Mahara Shala/Laura Humphreys studio (“Class”), and as a condition of entry, I HEREBY AGREE to the following terms and conditions:
1. Risk Warning, Acceptance of Risks, Release and Indemnity
1.1 I am aware that participating in exercise contains elements of risk, both obvious and inherent, and that by participating in a Class I will be exposed to such risks. The risks involved may result in property damage and/or personal injury including illness, disease, or death.
1.2 I fully appreciate the nature and extent of all risks involved and by participating in a Class I freely, voluntarily, and absolutely ACCEPT ALL RISKS howsoever arising, whether caused by the negligence of Mahara Shala/Laura Humphreys and the Associated Entities, or otherwise.
1.3 By entering a Class, I vouch that I have no known medical conditions which would preclude me from participating. I will immediately notify Mahara Shala/Laura Humphreys in writing of any change to my fitness and ability to participate.
1.4 To the full extent permitted by law, I agree to WAIVE all and any claim, right, or cause of action which I or my heirs, successors, executors, administrators, agents, and assigns might otherwise have against Mahara Shala/Laura Humphreys and the Associated Entities for or arising out of Death, Illness, or Injury sustained during or incidental to my participation.
1.5 To the full extent permitted by law, I agree to RELEASE AND DISCHARGE Mahara Shala/Laura Humphreys and the Associated Entities from all liability to me, my personal representatives, heirs, and next of kin for Death, Illness, or Injury arising out of or incidental to my participation.
1.6 To the full extent permitted by law, I agree to INDEMNIFY AND HOLD HARMLESS Mahara Shala/Laura Humphreys and the Associated Entities against all claims, demands, actions, suits, proceedings, damages, costs, losses, or liabilities of any kind (including legal costs) arising as a consequence of my acts or omissions.
1.7 I agree that the liability of Mahara Shala/Laura Humphreys in relation to any recreational service (Competition and Consumer Act 2010 (Cth), s139A; Civil Liability Act 2003 (Qld)) for death, injury, illness, or disease is EXCLUDED.
1.8 I acknowledge that this constitutes a “risk warning” under the Civil Liability Act 2003 (Qld), and that certain statutory rights and guarantees under consumer law have been excluded, restricted, or modified as permitted.
2. Medical Information and Treatment
2.1 I understand I should not participate in a Class unless I have trained appropriately and been cleared by a qualified medical practitioner.
2.2 I agree that I remain responsible for my own health care and will stop immediately if I experience faintness, dizziness, pain, or shortness of breath.
2.3 I consent to receive medical treatment, including examination, first aid, defibrillation, or ambulance transport, if deemed necessary by Mahara Shala/Laura Humphreys or Associated Entities.
3. Personal Information and Publicity
3.1 I agree that Mahara Shala/Laura Humphreys and Associated Entities may collect, store, and use my Personal Information in accordance with Mahara Shala/Laura Humphreys’ privacy policy.
4. Safety and Insurance
4.1 I acknowledge that safety precautions undertaken by Mahara Shala/Laura Humphreys are a service to me and not a guarantee of my safety.
4.2 I acknowledge that any insurance cover provided may not cover me for all loss, injury, or damage sustained.
5. Pricing
5.1 Mahara Shala/Laura Humphreys may, at its discretion, amend prices for goods and services.
5.2 Unless otherwise specified, all prices are inclusive of GST and will be displayed prior to purchase.
6. Online Membership
6.1 Members may not share, give, or sell login details to any other person or entity. Breach may result in suspension or termination without refund.
6.2 Online content is not directed to persons under 18 years of age. By providing information, members represent that they are 18 or older.
7. Online Free Trial Periods
7.1 Members who sign up for a free trial will automatically be charged at the end of the trial if they do not cancel before the trial ends.
7.2 By providing payment details to access a free trial, members authorise automatic billing unless cancelled before expiry.
7.3 Free trials are available to new users only, at our discretion, and cannot be combined with other offers.
7.4 Users are eligible for one free trial only, even with a different email.
7.5 We reserve the right to revoke free trial access at any time.
8. Online Membership Payment and Refunds
8.1 Membership fees will be billed at the start of the paying portion and each month/quarter/year thereafter unless cancelled.
8.2 Payments are automatically billed to the nominated method on the calendar day corresponding to the start date.
8.3 We reserve the right to amend billing timing if a payment method fails.
8.4 Payments are generally non-refundable, and no credits are issued for partially used periods.
8.5 Following cancellation, access continues until the end of the billing cycle.
8.6 This does not affect rights under the Australian Consumer Law, which provides guarantees that cannot be excluded. If a service fails to meet a consumer guarantee, remedies such as repair, replacement, or refund may apply.
8.7 Memberships may be temporarily paused (“frozen”) in cases of serious illness or injury, with supporting documentation. Freezes are for full calendar months only, minimum 1 month and maximum 6 months.
8.8 It is the member’s responsibility to manage and cancel their own subscription through their account settings before the next billing date.
9. Online Membership Cancellations
9.1 Members may cancel at any time via their membership settings.
9.2 Access continues until the end of the current billing cycle.
9.3 To avoid further charges, cancellation must be completed before the recurring payment date.
9.4 If not cancelled prior, the member will be charged for the next billing period.
9.5 A cancellation confirmation email will be sent automatically once processed. If not received, members must contact support.
9.6 It is the member’s responsibility to ensure cancellation is completed and confirmed.
10. Online Challenges
10.1 Cancelling during a challenge revokes immediate access to that challenge.
10.2 Cancelling during a challenge makes the member ineligible for prizes or giveaways.
10.3 Participants must hold a current, paid membership. Challenges are not open to free trial users or accounts in arrears.
11. Termination
11.1 Mahara Shala/Laura Humphreys may terminate membership or access without notice for illegal, offensive, abusive, or inappropriate behaviour (including online conduct), as reasonably determined by Mahara Shala/Laura Humphreys, whether occurring on premises, online, or directed at staff, members, or participants.
12. Basis of Agreement
12.1 These Terms and Conditions apply exclusively to the provision of goods and services by Mahara Shala/Laura Humphreys and cannot be varied without written agreement.
12.2 Mahara Shala/Laura Humphreys may amend these Terms by notice published on the website. Variations take effect from the specified date, or 4 weeks after publication if no date is specified.
12.3 This Agreement is governed by the laws of Queensland, Australia. I submit to the non-exclusive jurisdiction of the courts of Queensland.
13. Defined Terms and Interpretation
13.1 Associated Entities means all persons, corporations, or entities connected with organising, promoting, sponsoring, supporting, running, or staging a Class, including officers, directors, and employees of Mahara Shala/Laura Humphreys or its related bodies corporate.
13.2 Death, Illness or Injury means (a) death; (b) physical or mental injury (including recurrence or aggravation); (c) contraction, aggravation, or acceleration of a disease; (d) any harmful or disadvantageous condition arising or recurring.
13.3 Personal Information has the meaning given under the Privacy Act 1988 (Cth), including name, email, phone, address, occupation, age, height, and weight.
13.4 References to persons include corporations and their officers, directors, employees, agents, and representatives.
13.5 Obligations under this agreement may be enforced by Mahara Shala/Laura Humphreys on behalf of beneficiaries.
